Car on se retrouve écartelé entre deux choix également impossibles: la surenchère infinie de sa propre puissance et l'anéantissement. Il me semble que Nietzsche a été extrêmement loin dans cette voie, jusqu'à ce que le fil casse. Dans ce sens – je le répète, ce n'est là que ma compréhension des choses – je partage l'avis de Jean-Marie et mushotoku-nad, en disant que Nietzsche n'aurait pas connu l'éveil tel qu'on l'entend ici. Il est resté sur le pas de la porte, refusant farouchement le lâcher-prise salvateur – qu'il aurait pris pour un aveu de faiblesse –, refusant de dire ces mots: "Que Ta volonté soit faite!", les mots par lesquels tout se trouve accompli, persistant au contraire à braver la tempête plutôt que d'accorder à Cela toute-puissance sur lui-même. Eternel retour Lorsqu’on vit un moment d’une totale intensité, on sent bien qu’on touche l’essence de l’être. A partir d’une certaine intensité, on débouche sur quelque chose de substantiel, quelque chose qui EST, et donc qui nécessairement dépasse le petit moi. Simplement, dans un cas comme celui-ci, on reste convaincu qu’il s’agit d’un état d’exception. On a touché l’éveil, la réalité de l’être, mais on n’y est pas entré. Y entrer, c’est réaliser que ce moment que l’on vit comme un état d’exception a en fait toujours été là, que ce n’est véritablement pas un moment d’exception, mais notre vraie nature, la nature de ce qui EST, et que l’état d’exception c’est celui d’en être séparé parce qu’on s’identifie à une illusion. Tant qu’on n’a pas réalisé cela, on croira nécessairement que les seuls instants vrais de notre vie sont ces instants d’exception durant lesquels on communie à l’être, et que tout le reste est sans valeur. C’est dans ce sens que je comprends la théorie de l’éternel retour de Nietzsche, qui pour moi a toujours eu un caractère angoissant. Revivre éternellement le retour du même. Ou plus précisément, car c’est cela qu’entendait Nietzsche, revivre éternellement le retour de ces moments d’exception, ces seuls moments réels. Car du moment qu’on pense qu’eux seuls sont réels, qu’eux seuls sont enracinés dans l’être éternel, l’évidence s’impose que d’une part ils ne sauraient disparaître, et que d’autre part tout le reste ne saurait avoir d'existence réelle. This book reimagines the compositional semantics of comparative sentences using words such as more, as, too, and others. The book's central thesis entails a rejection of a fundamental assumption of degree semantic frameworks: that gradable adjectives like tall lexicalize functions from individuals to degrees, i.e., measure functions. I argue that comparative expressions in English themselves introduce “measure functions”; this is the case whether that morphology targets adjectives, as in *taller* or *more intelligent*; nouns, as in *more coffee*, *more coffees*; verbs, (...) such as *run more*, *jump more*; or expressions of other categories. Furthermore, she suggests that expressions that comfortably and meaningfully appear in the comparative form should be distinguished from those that do not in terms of a general notion of "measurability": a measurable predicate has a domain of application with non-trivial structure. This notion unifies the independently motivated distinctions between, for example, gradable and non-gradable adjectives, mass and count nouns, singular and plural noun phrases, and telic and atelic verb phrases. Based on careful examination of the distribution of dimensions for comparison within the class of measurable predicates, I tie the selection of measure functions to the specific nature and structure of the domain entities targeted for measurement. The book ultimately explores how, precisely, we should understand semantic theories that invoke the "nature" of domain entities: does the theory depend for its explanation on features of metaphysical reality, or something else? Such questions are especially pertinent in light of a growing body of research in cognitive science exploring the understanding and acquisition of comparative sentences. (shrink)

Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (ii) (...) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

The argument of this article is that the dual-nature thesis is not only capable of solving the problem of legal positivism, but also addresses all fundamental questions of law. Examples are the relation between deliberative democracy and democracy qua decision-making procedure along the lines of the majority principle, the connection between human rights as moral rights and constitutional rights as positive rights, the relation between constitutional review qua ideal representation of the people and parliamentary legislation, the commitment of legal argumentation (...) to both authoritative and non-authoritative reasons, and the distinction between rules as expressing a real “ought” and principles as expressing its ideal counterpart. All of this underscores the point that the dual nature of law is the single most essential feature of law. (shrink)

Which concepts should we use to think and talk about the world, and to do all of the other things that mental and linguistic representation facilitates? This is the guiding question of the field that we call ‘conceptual ethics’. Conceptual ethics is not often discussed as its own systematic branch of normative theory. A case can nevertheless be made that the field is already quite active, with contributions coming in from areas as diverse as fundamental metaphysics and social/political philosophy. This article aims at conceptualising the notion of embarrassment as a negativistic figure of thought that takes the experience of one’s own non-sovereignty as a starting point and emphasises an engagement with situations of not-knowing. This consideration is clarified in discussion with the figure of Socrates or with the philosophical attitude of Socrates. Because the negativistic thrust of the conceptualisation undertaken is reminiscent of irony, the paper then addresses the question of what distinguishes embarrassment understood as a figure of thought (...) from irony. For this purpose, Kierkegaard’s reading of Socratic irony is drawn upon. It is shown that irony is inherently a negativism, which in the last consequence aims at a retention of rights; but this is exactly what embarrassment avoids, because, as the article shows, it is not a negativism of strength, but of weakness. This paper introduces a novel method to control the operation of the active suspension system. In this research, a quarter-dynamic model is used to simulate the vehicle’s vibrations. Besides, the sliding mode-PID-integrated algorithm with five state variables is proposed to be used. This is a completely original and novel algorithm. The process of establishing the control algorithm is clearly described. The simulation is performed by the MATLAB software. The results of the paper have shown the advantages of the sliding mode-PID (...) algorithm used in this research. Accordingly, the displacement and acceleration of the sprung mass were significantly reduced when this algorithm was used. The maximum and average values of the displacement of the sprung mass are only 1.31% and 1.29%, respectively, compared with the situation of the vehicle using a passive suspension. Similarly, the value of the acceleration is 6.98% and 2.94%, respectively. In addition, the phenomenon of “chattering” has also been significantly reduced when using this controller. In the future, some more complex algorithms can be proposed. (shrink)

The article begins with an outline of the balancing construction as developed by the German Federal Constitutional court since the Lüth decision in 1958. It then takes up two objections to this approach raised by Jürgen Habermas. The first maintains that balancing is both irrational and a danger for rights, depriving them of their normative power. The second is that balancing takes one out of the realm of right and wrong, correctness and incorrectness, and justification, and, thus, out of the (...) realm of the law. The article attempts to counter these objections by showing that there exists a rational structure of balancing that can be made explicit by a “Law of Balancing” and a “Disproportionality Rule.” These rules show, first, that balancing is not a danger for rights but, on the contrary, a necessary means of lending them protection, and second, that balancing is not an alternative to argumentation but an indispensable form of rational practical discourse. Various emerging technologies, from social robotics to social media, appeal to our desire for social interactions, while avoiding some of the risks and costs of face-to-face human interaction. But can they offer us real friendship? In this book, Alexis Elder outlines a theory of friendship drawing on Aristotle and contemporary work on social ontology, and then uses it to evaluate the real value of social robotics and emerging social technologies. In the first part of the book Elder develops a (...) robust and rigorous ontology of friendship: what it is, how it functions, what harms it, and how it relates to familiar ethical and philosophical questions about character, value, and well-being. In Part II she applies this ontology to emerging trends in social robotics and human-robot interaction, including robotic companions for lonely seniors, therapeutic robots used to teach social skills to children on the autism spectrum, and companionate robots currently being developed for consumer markets. Elder articulates the moral hazards presented by these robots, while at the same time acknowledging their real and measurable benefits. In the final section she shifts her focus to connections between real people, especially those enabled by social media. Arguing against critics who have charged that these new communication technologies are weakening our social connections, Elder explores ways in which text messaging, video chats, Facebook, and Snapchat are enabling us to develop, sustain, and enrich our friendship in new and meaningful ways. The group also carried (...) out absolutism, denied the development of human knowledge to the accompaniment of the development of practice, and negated the absoluteness of the criterion of practice. Therefore, a correct elucidation of the relativity and absoluteness of the criterion of practice is necessary for the elimination of the theoretical confusion caused by the "gang of four" and of its baneful effects. While theory and research indicate that top management team (TMT) attributes play a crucial role in shaping responsible practices, how and when TMT faultlines affect environmental, social, and governance (ESG) performance remains an open question. This study aims to fill this research gap by integrating social categorization theory with the faultline literature. Using a sample of Chinese listed firms over a 12-year period, our findings indicate that TMT faultlines can significantly inhibit ESG performance, and managerial myopia is the primary channel (...) through which the negative effect operates. In addition, our study reveals that negative attainment discrepancy significantly amplifies the inhibitory effect of TMT faultlines on ESG performance. Intriguingly, this inhibitory effect is mitigated in firms with strong Confucian culture. Our study also reveals variations in the impact of TMT faultlines on ESG performance concerning the type of faultlines and the level of industry competition. These findings not only contribute to the literature on TMT faultlines and upper echelons but also provide valuable guidance for managers in adeptly navigating the dynamics of TMT composition. This year marks the 50th anniversary of the birth of the celebrated Wigner distribution function. Many advances made in various areas of science during the 50 year period can be attributed to the physical insights that the Wigner distribution function provides when applied to specific problems. In this paper the usefulness of the Wigner distribution function in collision theory is described.

Trajectories along which phase-space points of the Wigner distribution function move are computed for a Gaussian wave packet moving under the influence of a weak perturbative potential. The potentials considered are a potential step, a potential barrier, and a periodic potential. Trajectories computed exhibit the complex, nonlocal nature of quantum dynamics. It is seen that quantum interference, which takes place in the time development of the wave packet, is taken care of in a simple way by the Wigner trajectory method (...) presented here. (shrink)

This study addressed the questions of perceived importance of social responsibility information (SRI) characteristics in a decision context, as well as the attitudes of institutional investors toward social responsibility involvement. The results showed that SRI presently disclosed in company annual reports did not have any significant impact on institutional investors' decisions. However, if SRI were presented in quantified, financial form, and were focused on product improvement and fair business practices, such information would be perceived as more important for investment decisions. An effective approach is introduced to predict the magnitude of reservoir-triggered earthquake, based on support vector machines and fuzzy support vector machines methods. The main influence factors on RTE, including lithology, rock mass integrity, fault features, tectonic stress state, and seismic activity background in reservoir area, are categorized into 11 parameters and quantified by using analytical hierarchy process. Dataset on 100 reservoirs in China, including the 48 well-documented cases of RTE, are collected and used to train and validate the prediction (...) models established with SVM and FSVM, respectively. Through numerical tests, it is found that both the SVM and FSVM models are effective in the prediction of the magnitude of RTE with high accuracy, provided that sufficient samples are collected. While the results of FSVM which is extended from SVM by introducing a fuzzy membership to reduce the influence of noises or outliers are found to be slightly less accurate than those of SVM in the current analysis of RTE cases. The reason might be attributed to the high discreteness of the sample data in the current study. (shrink)

Hai, Peter NV Lay people have always played a vital role in the life and mission of the church but it is only after the Second Vatican Council that the question of the laity has come into focus in a new way in Catholic theological reflection. Indeed, in the wake of Vatican II, the council that introduced a Copernican shift in the Catholic understanding of the laity, lay people have become the theme of a Synod of Bishops, the subject of (...) an Apostolic Exhortation, and the topic of several pastoral statements of national conferences of bishops. This paper begins with a review of the state of the question highlighting the need for a comparative investigation of the theologies of the laity according to John Paul II, the Federation of Asian Bishops' Conferences, and the Vietnamese Episcopal Conference. It then highlights the differences and convergences in these theologies. As all three theologies draw their inspiration from the teachings of Vatican II, and a prominent element of the council's concerns was the emphasis on the universal call to holiness, we will also provide a detailed comparison of this notable aspect across these theological systems. Our argument is that while some minor points of divergence and disagreement remain there is a greater convergence and agreement between these theologies of the laity. (shrink)
